Spot Me Finance Pty Ltd (“SMF”, “we” or “us” - ABN 18 162 037 916) is a licensed credit provider (Australian Credit Licence Number 450321) offering short-term, small amount loans.

  1. Contract

    Access to and use of the SMF website located at www.spotmenow.com.au and any Mobile Applications (collectively referred to as the “Site”) and the services available through the Site are subject to the following Terms of Use.
    The words 'you' and 'your' refer to users of the Site.
    The material on the Site is published by us and is intended for use in Australia. The Site is not intended for use outside Australia. We make no claim that the information contained on the Site is appropriate or may be downloaded legally outside Australia. If you access the Site from outside Australia, you do so at your own risk and you are responsible for compliance with the laws in your own jurisdiction.
    These Terms of Use create a legal and binding contract between you and us.
  2. Your Consent

    By accessing, viewing or otherwise using the Site, or any material available on the Site, you indicate that you accept these Terms of Use. As such, you should review these Terms of Use, as they are subject to change.     You agree that in using the Site you will not, either directly, or indirectly through another party, use any robot, spider, screen scraper, data aggregation tool or other device or process to process, monitor, copy or extract any web pages on the Site or any of the information, content or data contained within or accessible through the Site, without our prior written permission. Further you agree not to use any process to aggregate or combine information, content or data contained within or accessible through the Site with information, content or data accessible via or sourced from any third party. In addition you agree not to use any information on or accessed through the Site for any commercial purpose or otherwise (either directly or indirectly) for profit or gain. You also agree not to reverse engineer, reverse assemble, decompile, or otherwise attempt to discover source code or other arithmetical formula or processes in respect of the software underlying the infrastructure and processes associated with the Site, or copy, reproduce, alter, modify, create derivative works, or publicly display, any part of any content from the Site without our prior written permission.
  8. Unlawful or Prohibited Use

    You must not use the Site in any way that is unlawful or prohibited by these Terms of Use or any other condition or notice on the Site. You are prohibited from using the Site in any way that may cause damage to the Site or another person's use of the Site.

    You agree, when applying for or entering into a credit contract through the Site, to receive Credit Guides, Contracts and any other legal or disclosure document(s) required by law, electronically via email to an email address you provide, or by accessing or downloading the document online, at the Site, or at another site we direct you to.
    You agree to complete the relevant applications forms honestly and completely.
  10. Online Applications

    When you send a completed online application to us, we retain the information contained in that application for as long as our relationship with you lasts, and for a reasonable period of time after it ends.
    You may be able to suspend and save online applications, so you can complete and send the applications at a later time. If you suspend or save your application, the information that you have entered will be retained in our systems so that you may recover the information when you resume your application. Online applications that have been suspended or saved may be viewed by us.
    We will not be liable or responsible for:
    • any failure to perform, or delay in the performance of, any of our obligations under these Terms of Use that is caused by any act or event beyond our reasonable control, including failure or suspension of public or private telecommunications networks;
    • the Site not meeting your individual requirements or the Site containing defects or errors. It is your responsibility to ensure that the facilities and functions of the Site meet your requirements;
    • any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your mobile device, data or proprietary material due to your use of the Site; or
    • breaches caused by a third party accessing your SMF account as a result of your failure to ensure the security of access to the Site from your computer or mobile device.
  11. Security

    We regularly review our site security measures, and take reasonable efforts to ensure that the most up-to-date encryption methods are used. However, we cannot guarantee that information that you transmit over the internet is entirely secure.
    We take reasonable steps to preserve the security of cookie and personal information in accordance with our Privacy Policy. If your browser is suitably configured, it will advise you whether the information you are sending us will be secure (encrypted) or not secure (unencrypted).
    You understand that any message or information you send using the Site may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.
    All content and services on or available through the Site are provided on an 'as is' basis and we do not make any representation or give any warranty or guarantee in respect of the Site or its content.
    When you submit information via the Site, you accept that you do so at your own risk. We take all reasonable care to ensure that information that is received by us is secure in our systems, and we encrypt the data prior to transmitting it via the internet to third parties. However, we can never guarantee that the information we receive is secure. We do not guarantee that the Site is virus free, or that access to the Site will be free from interruption. By using the Site, you accept that you do so at your own risk.

    To the extent permitted by law, you release us from any liability, in contract, tort (including negligence), equity or under statute, for any damages, including, without limitation, direct or indirect, special, incidental, compensatory, exemplary or consequential damages, losses or expenses, including without limitation lost or misdirected orders, lost profits, lost goodwill, or lost or stolen programs or other data, however caused and arising out of or in connection with:

    • any failure or performance, error, omission, interruption, defect, delay in operation or transmission; or

    • Your disclosure of your login, username, password, or any other applicable security features from time to time to any other person, or your failure to take reasonable precautions in the protection of login, username, password or other applicable security features.

    All trade names, brand names, trade symbols, logos, slogans, trade marks or services marks are trademarks or proprietary interests of Spot Me Finance. There are other trade names, brand names, trade symbols, logos, slogans, trade marks, service marks, brand names, company names, logos, slogans, trade marks or service marks indicated on the Site that are the property of their respective owners.
  14. Emails

    The content of emails that you send to us (and our responses) are stored and also monitored for security reasons.
  15. Advertising

    We may advertise our services online through third party websites. When you visit a third party website which displays an advertisement for our services, that website may use cookies and other means to collect information such as the server your computer is logged onto, your browser type, the date and time of your visit; and the performance of their marketing efforts.


    When you access the Site (our Site) after viewing one of our advertisements on a third party website, the advertising company collects information on how you utilise the Site (our Site), e.g. which pages you view and whether you complete an online application.


    We may receive a copy of that information, or access to that information as a result of an arrangement with the third party website. The purpose of this is allow us to evaluate the effectiveness of the advertising.

    If you breach any of the Terms of Use, our agreement to provide you with access to the Site and use the applications we make available ends immediately. All disclaimers and limitations of liability included in these Terms of Use will survive termination.
